Terms of Service Agreement

Welcome to our website. By accessing and using our services, you are agreeing to comply with and be bound by the following terms of service ("ToS"). Please review the following terms carefully.

1. Acceptance of Agreement

You agree to the terms and conditions outlined in this Agreement ("Agreement") with respect to our site (the "Site"). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, the content, products, or services provided by or through the Site, and the subject matter of this Agreement.

2. Scope of Services

Our services include various publishing and marketing services as detailed in the specific scope of work agreed upon by you (“The Client”) and Show Worx Media LLC (“SWM”). The services may include, but are not limited to, book structure and design, content creation and editing, video production, publishing, and promotional campaign management.

3. Payment Terms

Payment terms are as per the agreed schedule between The Client and SWM. An upfront payment option is available with a discount, or a structured payment schedule can be followed. Digital advertising budgets are negotiated separately, with SWM receiving a media management fee.

4. Communication

You are required to provide prompt feedback and necessary information to facilitate the service delivery.

5. Termination and Refund Policy

Either party may terminate the Agreement for breach of obligations. A pro-rata refund policy is applicable under certain termination conditions.

6. Confidentiality

Confidential information must be safeguarded and any disclosure requires written consent from the other party, except for information already public.

7. General Provisions

This Agreement is legally binding, and any changes require a written Annex. Disputes will be resolved amicably or through court proceedings in Denver, CO, USA, under the laws of the State of Colorado.

8. Acknowledgment

By using the services of SWM, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
